I was not aware of the Swedish rules... I have several of these stamps, put one on my scanner and uploaded the result. What if I edit the scan, add my own creative efforts to it? You may also want to remove the same image from the Erik Carlsson article. MH 18:45, 2004 Jun 10 (UTC)

Reading and thinking about fair use;

Fair use for Erik Carlsson and Saab 96

The image Saab96stamp.jpg is being linked here; though the picture is originally copyright I (MH 21:13, 2004 Jun 10 (UTC)) feel it is covered by fair use because:

  1. it is a low resolution scan of an actual stamp in my posession;
  2. copies could not be used to make illegal copies of the original stamp;
  3. it does not limit the copyright owners' right to sell the original stamps in any way;
  4. the image on the stamp is significant because it represents a historic Saab 96 car, event Monte Carlo Rally and person Erik Carlsson - all in one;
  5. the picture is only being used for non profit and informational purposes;
  6. its inclusion in the article adds significantly to the article because it shows the subject of this article and how the event depicted was very historically significant to the general public.

IANAL, and am quite happy to accept this argument. I agree that it should at least be fair use. I do think the use of material under a "fair use" provision (unless crystal clear, such as short quotes with attribution) should be avoided. A commercial re-user of Wikipedia content could probably not use this image. Remember, the GFDL does allow commercial use, provided that the rest of the license is adhered to. However, the current Wikipedia policy on use of images as "fair use" seems pretty liberal, and I do not want to get into an argument about that at this time.
It should also be noted that the rules concerning fair use vary between regions. I (from my not-a-lawyer POV) do not think this use of the image would be considered fair use under Swedish law, although it could in other contexts.
Wikipedia is USA (Florida) based, and US copyright laws apply, so does 'fair use' (but IANAL either, I am an engineer...)
